1. Introduction

These Terms of Service govern your use of Localee, including the mobile app, admin portal, and marketing website.

By using Localee, you agree to these Terms. If you do not agree, you must not use the Services.

2. Eligibility & Age Requirement

You must be at least 18 years of age to create an account or use Localee.

By using the Services, you confirm that:

• You are 18 or older, and
• Any information you provide is accurate

3. Accounts & Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity under your account
• Keeping your information accurate and up to date

Localee is not responsible for unauthorised access caused by your failure to secure your account.

4. Nature of the Service

Localee provides a technology platform that enables venues to manage digital memberships and communications.

Localee does not:

• Operate venues
• Sell or supply alcohol or gambling services
• Determine membership eligibility or benefits
• Enforce venue compliance with the law

All venue-related conduct remains the responsibility of the venue.

5. Digital Membership Cards - No ID Replacement

Digital membership cards:

• Are provided for convenience only
• Do not verify age or identity
• Are not a substitute for government-issued photo identification

Venues must continue to conduct age and ID checks as required by law.

6. Venue Obligations - Alcohol & Gambling

Venues acknowledge and agree that:

• All content, promotions, notifications, offers, and communications relating to alcohol, gambling, gaming, raffles, promotions, or inducements are solely the responsibility of the venue.
• Venues must comply with all applicable Commonwealth, State, and Territory laws, including but not limited to licensing, advertising, harm-minimisation, age-restriction, and responsible service requirements.
• Localee does not review, approve, monitor, or verify venue compliance with alcohol or gambling laws.
• Localee is not liable or accountable for any breach of alcohol or gambling laws by a venue, including penalties, fines, enforcement action, or claims arising from such breaches.

Venues indemnify Localee against any claims, losses, or liabilities arising from non-compliant alcohol or gambling content or conduct.

7. Underage Access & Liability Exclusion

To the maximum extent permitted by law:

• Localee is not liable for underage access to venue content, promotions, or services
• Localee is not responsible for a venue's failure to verify age or comply with licensing laws
• Responsibility rests with the venue and the individual user

8. Notifications & Communications

Notifications are sent by venues using the platform.

Localee does not control the content, accuracy, or legality of venue communications.

9. Acceptable Use

You must not:

• Misrepresent your age or identity
• Use Localee unlawfully or misleadingly
• Interfere with platform security or functionality

Breaches may result in suspension or termination.

10. Disclaimers & Limitation of Liability

Localee is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, our liability is limited to resupplying the Services or the cost of doing so.

Nothing in these Terms limits rights under the Australian Consumer Law.

11. Governing Law

These Terms are governed by the laws of Queensland, Australia and the Commonwealth of Australia.
